BARBARA C. LEON: A Chapter 13 bankruptcy is one of the chapters of bankruptcy. And it is typically defined as a reorganization bankruptcy, where the person is in typically a 36- to a 60-month payment plan.
There are typically three types of people that would file a Chapter 13 bankruptcy. The first and most common is someone who's facing foreclosure of their home. The second type of person is someone who has certain assets that they would otherwise lose in a Chapter 7. And the third type of person is typically someone who has too much income to qualify for a Chapter 7 bankruptcy would then qualify for a Chapter 13.
Filing for a Chapter 13 bankruptcy can allow someone to save their home from foreclosure, which would allow them to stay there with their family. They can also pay back a portion of their debt, such as credit cards and medical debt and so forth back to their creditors.
